By accessing the website at https://fittora.ai or using any services provided by Fittora AI Private Limited (“Fittora”, “we”, “us”, or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our services.

These Terms apply to all visitors, users, and merchants who access or use our service. We reserve the right to update these Terms at any time. Continued use of the service after changes constitutes acceptance of the updated Terms.

2. Description of Services

Fittora provides an AI-powered shopping assistant platform designed for Shopify merchants. Our services include, but are not limited to:

• Conversational product discovery and search for online stores.
• AI-driven size recommendations based on available product and user data.
• Product recommendation features, including “Complete the Look” and related suggestions.
• Customer support automation for ecommerce merchants via web and WhatsApp Business.

We reserve the right to modify, suspend, or discontinue any part of our services at any time with reasonable notice where practicable.

3. Eligibility and Account Responsibility

To use our services, you must be at least 18 years of age and have the legal authority to enter into a binding agreement on behalf of yourself or your business.

If you register for an account or access our services on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms.

You are responsible for:

• Maintaining the confidentiality of any credentials or API keys associated with your account.
• All activities that occur under your account or in connection with your use of our services.
• Ensuring that your use of our services complies with applicable laws and regulations, including data protection laws applicable to your customers.

4. Acceptable Use

You agree to use our services only for lawful purposes and in a manner consistent with these Terms. You must not:

• Use our services to transmit any content that is unlawful, harmful, abusive, defamatory, or otherwise objectionable.
• Attempt to gain unauthorised access to our systems, other user accounts, or related infrastructure.
• Reverse engineer, decompile, or attempt to extract the source code of any software underlying our services.
• Use our services to send unsolicited communications (spam) to end users or third parties.
• Violate any applicable laws, regulations, or third-party rights (including Shopify's or Meta's terms of service, where applicable).

5. Intellectual Property

All content, technology, trademarks, and intellectual property associated with the Fittora platform and website — including but not limited to software, designs, text, and logos — are the exclusive property of Fittora AI Private Limited or its licensors.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use our services solely for your own ecommerce business purposes, in accordance with these Terms.

You retain ownership of your store's product data and content that you provide to us. By using our services, you grant us the right to process and use that data to deliver the service as described.

6. Third-Party Integrations

Our services integrate with third-party platforms including Shopify and WhatsApp Business (Meta). Your use of these integrations is subject to the respective terms and policies of those platforms. We are not responsible for the availability, accuracy, or conduct of third-party services.

7. Disclaimer of Warranties

Our services are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. To the fullest extent permitted by law, Fittora disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the services will be uninterrupted, error-free, or entirely secure. AI-generated recommendations are provided for informational and convenience purposes and may not always be accurate.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Fittora AI Private Limited and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of, or inability to use, our services.

Our total liability to you for any claim arising out of or related to these Terms or our services shall not exceed the amounts paid by you to us in the three months preceding the claim.

9. Termination

Either party may terminate access to the services at any time. We reserve the right to suspend or terminate your access if we reasonably believe you have violated these Terms, without prior notice.

Upon termination, your right to use our services will immediately cease. Provisions of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, and dispute resolution) shall survive.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising out of these Terms shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka, India.
